Introduction and Acceptance of Terms
Welcome to PolygrAI Interviewer, a one-way interview platform provided by PolygrAI (“we,” “us,” or “our”). These Terms of Use (“Terms”) govern your access and use of the PolygrAI Interviewer service as an Interviewee (the individual invited to record responses in an interview). By accessing the interview link, recording your responses, or otherwise using our Service, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, do not participate in the interview or use the Service.
This Interviewee Terms of Use is intended to protect PolygrAI from liability arising out of your use of the Service and to inform you of your rights and obligations. It applies only to Interviewees. (If you are an interviewer or campaign organizer using PolygrAI, separate terms may apply.) If you have any questions or need support regarding these Terms or the Service, please contact us at hello@polygr.ai.
Definitions
For clarity in these Terms, we use the following definitions:
“Service” refers to the PolygrAI Interviewer platform and related services provided by PolygrAI that allow one-way video/audio interviews to be conducted and analyzed.
“PolygrAI Interviewer” is the product (part of the PolygrAI Analyzer suite) that enables interview campaigns, recording of interview responses, and AI-driven analysis of those responses.
“Interviewee” (“you” or “your”) means an individual who has been invited to participate in a one-way interview via the Service and who records and submits responses.
“Interviewer” means the person or entity that created the interview campaign and invited you to participate (for example, a prospective employer or organization). This party may also be referred to as the “Campaign Organizer” or “Invite Sender.”
“Interview” refers to the one-way interview session you participate in, which may include answering prerecorded or written questions by recording your video and audio responses.
“Content” means all information and material you submit during the Interview, including your video footage, audio recordings, spoken words, written text, and any other data captured (such as facial expressions, gestures, or other behavioral cues).
“Analysis” or “Report” refers to the automated evaluation, insights, scores, and summaries generated by PolygrAI’s system from your Interview (e.g. behavioral analysis, transcripts, emotion indicators, deception risk scores, etc.).
“Personal Data” means any information relating to an identified or identifiable individual, which in this context includes your recorded image, voice, and any data derived from your performance in the Interview.
(Other capitalized terms may be defined elsewhere in these Terms.)
Description of the Service and How It Works
PolygrAI Interviewer is a technology platform that records interview responses and analyzes them using a proprietary human behavioral analysis engine. As an Interviewee, you will:
Receive an invitation (typically via a unique link) to complete a one-way video interview. You can complete the interview using a web browser or supported application without needing to install specialized software.
Follow on-screen instructions to record your answers to the interview questions. This typically involves enabling your device’s camera and microphone to capture video and audio of your responses.
Submit your recorded responses through the platform. The system will then process the recordings to generate an Analysis Report for the Interviewer who invited you.
Key Functionalities of the Analysis (for transparency): PolygrAI’s analysis engine will automatically evaluate various aspects of your recorded responses in real time or after submission. The types of analysis that may occur include:
Facial Analysis: Detection of facial expressions or micro-expressions that may indicate emotions or stress (e.g. smiles, frowns, eyebrow movements).
Body Language: Observation of your posture, gestures, and physical movements (if visible) for potential indicators of confidence, discomfort, or other non-verbal cues.
Eye Gaze & Blinking: Tracking of eye contact direction and blink rate, which could be associated with cognitive load or nervousness.
Vocal Analysis: Monitoring of your speech patterns – tone of voice, pitch, speaking speed, pauses, and intonation – for signs of stress or emotional state.
Linguistic Analysis: Processing of your spoken words (transcribed to text) to identify linguistic patterns, keywords, or speech content that might suggest certain psychological or emotional states. This can include sentiment analysis (detecting if your language appears positive, neutral, anxious, etc.) and psycholinguistic profiling (looking for inconsistencies or potential deceptive language patterns in responses).
Physiological Inferences: PolygrAI Interviewer may estimate certain physiological signals from your video (for example, using remote photoplethysmography (rPPG) techniques to approximate heart rate or stress levels from subtle color changes in your face on camera). No physical sensors are attached; any such data is derived purely from the video feed.
Real-Time Scoring: The system might compute composite scores or indicators (e.g., a “deception risk score” or confidence level) by combining the various visual, vocal, and linguistic cues. These scores may update dynamically during your interview or be finalized afterward.
Deepfake Detection: For security, the system may analyze the video to ensure authenticity and verify that the recording is genuine (for example, detecting if a video has been manipulated or if someone is attempting to present pre-recorded or AI-generated footage as live).
The Analysis Report generated from these processes is made available to the Interviewer (the entity that invited you). It typically includes elements such as: a transcript of your answers, time-stamped notes of notable cues (e.g. detected emotions or hesitation at certain moments), visual highlights of facial or vocal cues, and overall summary scores (like an aggregate honesty or sentiment score). This Analysis is intended to assist Interviewers in their decision-making; it is not a definitive judgment on your character, truthfulness, or abilities. The Interviewer will review your actual responses alongside this automated Analysis.
Important: PolygrAI is not directly involved in the Interviewer’s use of this Analysis beyond providing the tool. We do not make hiring or evaluation decisions; those are made solely by the Interviewer (or their organization). The Service is a facilitator of the interview process and provides analytical insights for the Interviewer’s consideration.
Eligibility and Interviewee Responsibilities
By using the Service as an Interviewee, you confirm that:
You are at least 18 years old (or the age of legal majority in your jurisdiction) and legally capable of consenting to be recorded. Our Service is not intended for minors. If you are under the age of majority and have been invited to an interview (for example, for an educational opportunity), you must not proceed unless you have verifiable permission from a parent or legal guardian and it is lawful to do so.
All information you provide in the interview (including spoken answers and any written input) is your own and truthful to the best of your ability. You will not knowingly submit false, misleading, or plagiarized answers.
You will use the Service only for its intended purpose of participating in a legitimate interview. You agree not to engage in any misconduct such as having someone else take the interview in your place, using unauthorized aids where not permitted, or attempting to deceive the system (for example, using pre-recorded videos, voice-altering software, or other manipulation to falsify your responses).
You will conduct yourself in a respectful manner during your interview. You must not include any content that is harassing, hateful, defamatory, pornographic, illegal, or otherwise violates any laws or the rights of others. PolygrAI reserves the right to terminate or pause an interview if objectionable or harmful content is detected.
You have the necessary equipment and internet access to participate (e.g., a functioning webcam, microphone, and stable internet connection). PolygrAI is not responsible for technical failures on your side. It’s your responsibility to ensure your device meets the minimum requirements and to follow any guidelines provided (such as camera positioning, lighting, and sound clarity) to achieve a good recording.
User Accounts and Access to “My Interviews”
You generally do not need to create a personal PolygrAI account to participate in an interview when invited by an Interviewer – you can typically click the invite link and directly record your responses. However, certain features and rights (such as managing your submitted interviews or requesting deletion or retake) may require you to create an Interviewee Account on our platform. This account, if you choose to create one, will allow you to:
View Your Submissions: Access a “My Interviews” section where you can see a record of the interviews you have completed using PolygrAI Interviewer. This may include basic details like the name of the company or Interviewer, date of interview, and status (submitted, under review, etc.). Note that you may not have access to the Analysis or scores given to your interview unless the Interviewer chooses to share it with you.
Request a Retake: If the platform or the Interviewer’s settings allow retakes (for example, due to technical difficulties or by the Interviewer’s policy), you might request to retake an interview through the platform. Retake requests are subject to the Interviewer’s approval and the campaign’s rules.
Request Deletion of Your Data: Through your account’s privacy settings or the My Interviews section, you can submit a request to delete your interview data (see Data Deletion below for conditions).
Contact the Interviewer: If enabled, you may have a way to send a message or contact the Interviewer who invited you (for example, to clarify instructions or notify them of an issue), though this is typically done outside our platform.
Creating an Interviewee Account will require providing some personal information (such as your name, email, and setting a password). You agree that any information you provide for the account will be accurate. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. If you suspect any unauthorized access to your account, you must notify us immediately at hello@polygr.ai. We are not liable for any loss or damage arising from your failure to secure your account.
Note: If you choose not to create an account, you can still complete the interview as a guest. However, to exercise certain rights (like viewing or deleting your submission later), account creation may be necessary so we can verify your identity and associate you with your interview data.
Consent to Audio/Video Recording and Analysis
By proceeding with the interview on PolygrAI’s platform, you explicitly consent to the following:
Recording of Video and Audio: The Service will record your image and voice via your device’s camera and microphone during the interview. You consent to such recording and acknowledge that you are aware it is taking place. These recordings constitute personal data about you. If you do not consent to being recorded, do not continue with the interview.
Automated Analysis of Recordings: You consent to PolygrAI’s automated systems analyzing your video, audio, and any textual content for the purposes described above (e.g. extracting a transcript, evaluating behavioral cues, estimating stress levels, etc.). This processing may involve advanced algorithms, including artificial intelligence and machine learning models.
Use of Data for Service Provision: You consent to PolygrAI using your recorded data and analysis results to provide the Service to the Interviewer who invited you. This includes generating the Analysis Report and making it available to that Interviewer or the organization they represent. In practice, this means your interview video, audio, transcripts, and analysis outcomes will be accessible to the Interviewer through our platform. They may review, share, or use this information in accordance with their own processes (for example, as part of a hiring decision or evaluation).
Optional Future Use by You: If you have an account and choose to reuse or review your data (for example, viewing your previous interview videos in the My Interviews section), you consent to us retaining a copy of the necessary data to provide you that access.
You confirm that you understand the nature of PolygrAI’s Service. This includes understanding that PolygrAI will monitor various personal behavioral indicators (body language, tone of voice, etc.) during your interview and that this can reveal sensitive information such as your emotional state or stress level. Where required by law (especially if you are in a jurisdiction with specific privacy or surveillance laws, such as the EU’s GDPR or ePrivacy Directive), you provide your explicit informed consent to such processing.
If you are located in a region that requires two-party or all-party consent for recordings (e.g., certain U.S. states), by agreeing to these Terms and proceeding, you are signaling your consent to be recorded, and you should also be aware that the Interviewer (and PolygrAI, as the service provider) is recording you. Do not proceed if you object to being recorded or having your data analyzed in the manner described.
Privacy and Data Handling
Your privacy is extremely important to us. PolygrAI is committed to handling your data in compliance with applicable data protection laws, including the European Union General Data Protection Regulation (GDPR) where applicable. This section summarizes what data we collect, how it’s used, how long it’s kept, and your rights regarding your data. For more detailed information, please also refer to our Privacy Policy (if provided separately).
1. Data Collected: When you participate in an interview, the following personal data may be collected and processed:
Identification Information: If you create an account, we collect info like your name, email, and login credentials. If you participate without an account, we may still temporarily collect identifiers to associate your responses with the invitation (like an interview code or the email/ID you were invited through).
Video and Audio Recordings: Your live or recorded video image and audio (your voice) as you answer interview questions. This is the primary data used for analysis.
Derived Data (Analysis Results): The Service will create derived data such as transcripts of what you say, scores (e.g. “deception risk level” or emotional sentiment scores), and event markers (e.g. “long pause detected at 2:10”). These are inferences made by our algorithms from your recordings.
Technical Data: During your use of the Service, we may collect device and log information (e.g. browser type, device type, IP address, interview start/end times, error logs) to ensure the service runs smoothly and to troubleshoot issues if they arise.
We do not collect or ask for any government ID numbers, financial information, or other data not needed for the interview process. Please do not submit any unnecessary personal information during your interview beyond what is asked.
2. Purpose of Processing: All data we collect from you is used strictly for the following purposes:
Providing the Service: Enabling you to take the interview and enabling the Interviewer to review your responses. This includes recording and storing your responses, analyzing them, and delivering the analysis to the Interviewer.
Improving Your Experience: (If applicable) Providing you with features like replays of your recorded answers for review before submission, or quality checks (e.g., “your room is too dark” alerts), which may involve processing the video locally to guide you.
Support and Communication: If you contact us at hello@polygr.ai for help or use any support chat, we will use your contact info and the content of your queries to assist you.
Legal Compliance and Security: We may process and retain data as necessary to comply with legal obligations (e.g., data retention laws or lawful requests by authorities), to enforce our Terms, and to ensure the integrity and security of our platform (for example, using deepfake detection to prevent fraud).
Importantly, we do NOT use your personal data for any secondary purpose such as marketing, advertising, or selling data to third parties. Also, we will not use your interview recordings or analysis to train our AI models or for research without your consent. The data you provide is only used to deliver and improve the service for your interview and similar interview processes, not to develop new products unrelated to serving those interviews.
3. Data Sharing: Your interview data and analysis results are shared with the Interviewer (the organization that invited you). In GDPR terms, that organization is likely the Data Controller for the interview information, and PolygrAI acts as a Data Processor on their behalf. This means the Interviewer determines how they use the results (for example, in their hiring or evaluation process). PolygrAI does not independently share your personal data with other third parties, except:
Service Providers: We may use trusted third-party sub-processors (such as cloud hosting services or video processing services) as part of running the platform. These providers are contractually bound to protect your data and only act on our instructions.
Legal or Safety Reasons: If required by law or court order, or to protect rights, safety, and security of PolygrAI, our users, or others, we might disclose relevant data to authorities or appropriate parties.
In Case of Business Transfer: If PolygrAI undergoes a merger, acquisition, or sale of assets, your data may be transferred to the successor entity under the same privacy commitments. We will notify you of any such change if it impacts your personal data.
We will never sell your personal data, and we do not disclose it to any third party for their own marketing or purposes unrelated to the interview you are participating in.
4. Data Storage and Retention: PolygrAI’s design philosophy includes privacy by design – much of the analysis processing occurs in-memory and we strive to minimize data storage. However, your actual interview recordings and analysis may be stored on our secure servers to fulfill the Service. By default:
Retention by PolygrAI: We retain your raw interview data (video, audio, transcripts, analysis) for a limited duration to serve the Interviewer’s needs and to allow you access if needed. Unless otherwise instructed by the Interviewer, we retain interview data for at least 3 months from the date of submission. This retention period ensures the Interviewer has sufficient time to review and you have the opportunity to access or request changes.
Extended Retention by Interviewer: The Interviewer (data controller) might have their own policy or legal obligation to retain interview data for a longer period (for example, for record-keeping or audit purposes). In such cases, PolygrAI may store the data on their behalf until it is no longer needed, but any extended retention is under the Interviewer’s responsibility and subject to their privacy policy.
Deletion After Retention: We do not keep personal interview data indefinitely. If neither you nor the Interviewer requests extended retention, we will permanently delete or anonymize your personal data after the retention period elapses. Anonymized data (with all personal identifiers removed) might be kept for statistical purposes or to improve the service, but this data will not identify you and is no longer personal data.
5. Data Deletion and Your Rights: As an Interviewee, you have rights regarding your personal data. These include the right to access your data, correct any inaccuracies, and request deletion of your data in certain circumstances. PolygrAI provides you ways to exercise these rights:
Deletion Requests: You may request deletion of your interview recording and associated data. However, please note that Interviewers generally require that interview submissions be retained for at least 3 months after you submit, to complete their review process. Therefore, our policy is that deletion requests will be honored after 3 months from the submission date of the interview. Once that initial period has passed, you can submit a deletion request (either through the My Interviews section if you have an account, or by emailing us at hello@polygr.ai with details of your interview). After verifying your identity and ownership of the data, we will delete your interview data within 14 days of your request, and notify both you and the Interviewer of the deletion.
Access and Correction: If you have an account, you may access basic information about your interview (such as the date and the fact you completed it). If you believe any personal data we have (for example, your name or contact info) is incorrect, you can request correction by contacting us. Note that the content of your interview answers or the analysis (like scores) generally cannot be “corrected” as they are a historical record of an event, but if you believe there’s an error in the personal data (like a mis-transcribed name), we will review such requests.
Objection or Restriction: You may contact us or the Interviewer to object to further processing of your data or ask that it be restricted (for instance, if you believe it was collected unlawfully). For example, if you withdraw your job application and want the interview not to be considered, you can request us to flag or restrict the data for that Interviewer. We will coordinate with the Interviewer as necessary.
Data Portability: To the extent applicable, you may request a copy of your personal data that you provided to us in a common format. Typically, this might include your video file and transcript. We will provide this to you upon request, subject to verifying your identity and subject to any confidentiality concerns (e.g., if the interview questions are proprietary to the Interviewer, we may need their consent or to redact certain parts).
Please understand that to maintain a fair and secure process, we cannot delete or alter your interview data immediately upon submission, especially not before the Interviewer has had a chance to use it, unless there is a compelling legal reason. Any deletion will also be communicated to the Interviewer, as it may affect their records.
6. Security Measures: PolygrAI implements industry-standard security measures to protect your data, including encryption of data in transit (e.g., using HTTPS for video uploads) and at rest, secure server storage, and strict access controls. Only authorized personnel and the Interviewer (and those they authorize) have access to your interview recordings and analysis. Despite our efforts, no system can be 100% secure; by using the Service, you acknowledge that there is always some risk of a data breach or unauthorized access. In the unlikely event of a data breach affecting your information, we will follow applicable laws to inform you and contain the issue.
7. Consent and Legal Basis: By agreeing to these Terms, you are providing consent for PolygrAI to process your personal data as described. In GDPR terms, the legal basis for processing your data is your consent and the legitimate interest of the Interviewer in evaluating candidates (or other stated purpose of the interview). You have the right to withdraw your consent at any time, but note that withdrawing consent does not retroactively undo processing already done and will likely prevent completion of the interview or continued consideration of your application. To withdraw consent, discontinue the interview and notify the Interviewer and us of your decision.
For more information on how we handle data, please review our Privacy Policy. If anything in these Terms of Use appears to conflict with the Privacy Policy, the more privacy-protective provision will prevail with regard to personal data.
No Endorsement or Guarantee of Outcomes
PolygrAI is a tool provider and does not guarantee any outcome from your interview. We do not guarantee that:
You will be selected for the next stage or offered any position or opportunity as a result of using our Service. The Interviewer’s decisions are outside our control.
The questions asked by the Interviewer will be appropriate, relevant, or lawful. (However, if you encounter inappropriate or illegal questions, please report this to the Interviewer and consider notifying us at hello@polygr.ai – while we are not responsible for the content of questions, we take reports seriously and may intervene or advise Interviewers for compliance.)
The interview process will be free of technical issues or that the platform will be available at all times. (We strive for high availability but maintenance, network issues, or other problems can occur.) If a technical problem with our Service prevents you from completing the interview, please contact us and your Interviewer to arrange a remedy (such as a rescheduled interview).
PolygrAI does not endorse any particular Interviewer, employer, or organization that uses our platform. Participating in an interview on PolygrAI does not imply any employment or contractual offer. Always exercise your own judgment and due diligence regarding opportunities presented to you.
Accuracy and Disclaimer of Automated Analysis
Important: The PolygrAI analysis provided to Interviewers is probabilistic and for informational purposes only. While our system is based on scientific research and advanced AI algorithms, no automated system is infallible. You acknowledge and accept the following regarding the Analysis:
Not a Determinative Assessment: The scores, flags, or insights generated (such as a “deception risk score” or detected emotion) do not prove or guarantee that a statement is truthful or deceptive, or that you possess any particular trait. There are many factors that can affect human behavior, and the Analysis is only an estimate or interpretation of those external behaviors. For example, a high stress indicator might simply mean you were nervous in a job interview (which is common and normal), not that you were dishonest.
Margin of Error: PolygrAI’s current accuracy rates for detecting certain behavioral cues are estimated to be around 70-72% under optimal conditions. This means there is a significant margin of error, and roughly 1 out of 3 inferences could be incorrect or misleading. The Analysis might occasionally flag honest answers as suspicious or miss cues that are present. You agree that you understand these limitations.
Human Review Required: The Analysis is intended to be reviewed by human Interviewers who should use it only as one factor among many in their evaluation. We advise all Interviewers (and by extension, you should understand) that no decisions should be made based solely on the AI analysis. PolygrAI explicitly instructs Interviewers that the tool is a supportive aid, not a polygraph or a definitive test. If you believe that an Interviewer is using the tool in a purely automated way to make a decision about you, please inform them of your right to request human intervention (especially if you are under GDPR jurisdiction, you have rights regarding not being subject solely to automated decisions with significant effects). PolygrAI cannot force an Interviewer’s hand, but we emphasize responsible use in our client terms.
No Professional Advice: Any feedback or indicators from the system are not professional psychological, legal, or financial advice about you. For example, if the system indicates you seemed “anxious,” it is not a medical diagnosis of anxiety nor an assessment of your personality. It is a raw analysis output with limited context.
By accepting these Terms, you agree that you will not interpret the Analysis output as a factual determination and you will not hold PolygrAI responsible for the accuracy or inaccuracy of such outputs. If you do obtain access to your Analysis results and disagree with them, you acknowledge that the results are generated by an automated system and may be incorrect. Your recourse in such a case may be to communicate with the Interviewer for a clarification or another chance, but PolygrAI makes no guarantee that any such remedy will be provided.
Intellectual Property Rights
1. PolygrAI’s Intellectual Property: All rights, title, and interest in and to the PolygrAI Interviewer platform and analysis engine, including but not limited to the software, algorithms, models (including the behavioral analysis models), dashboards, reports format, website design, trademarks “PolygrAI” and associated logos, and any documentation or content provided by us, are the property of PolygrAI or its licensors. These are protected by copyright, trade secret, patent, and other intellectual property laws.
Using the Service does not grant you any ownership of or license to our intellectual property except for the limited right to use the Service for its intended purpose under these Terms. You may not reverse engineer, decompile, or attempt to extract the source code of our software; nor will you use any portion of our IP (such as the analysis methodologies or questions if provided by PolygrAI) for developing a competing service.
2. Content You Provide (Interview Responses): As an Interviewee, the content of your interview responses (your video, audio, and anything you say or submit) remains your property in terms of personal rights. PolygrAI does not claim ownership of your personal data. However, you hereby grant PolygrAI and the Interviewer a license to use your content as necessary to provide the Service. This means:
You grant PolygrAI a worldwide, royalty-free, sublicensable (to our service providers), permission to host, process, transmit, and display your content for the purpose of analyzing it and presenting it to the Interviewer, and for internal purposes such as debugging and improving the Service functionality. This license is limited to the scope of the interview process and related actions as described. PolygrAI will not use your content for purposes outside of this scope without obtaining additional consent from you.
You grant the Interviewer (the company/individual who invited you) rights to use your submitted interview content and the Analysis for their internal evaluation and record-keeping, consistent with the purpose for which you provided the interview (e.g., hiring or vetting). They may retain copies of your video and analysis in accordance with their own policies. Typically, this is considered part of your application or interaction with them. PolygrAI is not responsible for the Interviewer’s handling of your content once delivered to them, but we require that they treat it in accordance with applicable law (such as not disclosing it publicly without permission). If you have concerns about how an Interviewer might use or store your data, please refer to that Interviewer’s privacy policy or contact them directly.
By providing your content, you confirm that you have the right to be recorded and to share that content (for example, you are not infringing any other person’s rights by showing something in your video). You also agree that we may use anonymized or aggregated forms of your content for improving our services (e.g., training algorithms on patterns only after removing identifying details, as allowed by law). If we stated elsewhere that we will not use your data for training without consent, we will honor that – meaning any use for improving the service will involve either non-personal data or obtaining consent.
3. Interviewer’s Content: Sometimes the Interviewer may provide content via the platform (such as written questions, their company logo, etc.). You are only permitted to use that content for the purpose of participating in the interview. You should not copy or publish the Interviewer’s questions or any proprietary information you see in the interview interface (for example, some questions might be intellectual property of the Interviewer or PolygrAI’s question library). Respect confidentiality if the Interviewer has instructed that the interview is confidential.
Permitted Use and Restrictions
We grant you a limited, revocable license to access and use PolygrAI Interviewer solely for participating in the interview you were invited to, in compliance with these Terms. All rights not expressly granted are reserved by PolygrAI. In using the Service, you agree NOT to:
Use the Service for any unlawful or unauthorized purpose. This includes complying with all local, state, national, and international laws and regulations that apply to your participation (e.g., do not use the platform to engage in harassment, or to transmit any content that is illegal).
Interfere with or disrupt the Service. Do not attempt to hack, overload, or modify the Service, and do not use any automated means (bots, scripts) to attempt to access the Service beyond the provided interface. Any attempt to gain access to system data, other users’ data, or to bypass security measures is strictly prohibited.
Misrepresent your identity or impersonate another person during the interview. You must be the person invited. It is forbidden to have someone else complete the interview in your name or to use someone else’s name or credentials. PolygrAI may employ verification checks (including the deepfake detection and other measures) to ensure the integrity of the interview. If we suspect impersonation or fraud, we reserve the right to terminate or invalidate the interview and inform the Interviewer.
Record, copy, or distribute the interview questions or any part of the Service interface (except your own answers, which you have rights to). The platform and questions are proprietary; you should not take screenshots, record the screen, or otherwise reproduce the content for anything other than personal reference. (If you wish to practice or share something, get permission from the Interviewer or PolygrAI first.)
Reverse engineer or extract information about the analysis methodology. Our AI models and algorithms are proprietary trade secrets. You agree not to attempt to probe how the system generates results beyond normal use, and not to create derivative works based on our output (e.g. you cannot use the analysis report to train a competing model).
Violation of any of these rules may result in immediate termination of your access to the Service, and potential legal consequences if the violation is unlawful (for example, hacking or data misuse).
Suspension and Termination
PolygrAI reserves the right to suspend or terminate your access to the Service (or a particular interview) at any time if we suspect you have violated these Terms or if required for security and integrity. For instance, if our systems detect cheating, misuse, or content that violates laws or rights (such as hate speech), we may interrupt the interview and notify the Interviewer as appropriate. We are not obligated to allow you to restart an interview in such cases and the Interviewer may choose to disqualify your application – those decisions lie with the Interviewer.
Conversely, you have the right to stop using the Service at any time. If you choose to quit an interview before completion, you may do so (simply close the browser or app). Keep in mind that the Interviewer will be informed of incomplete submissions and may choose how to proceed (they might offer a reschedule or move on with other candidates). If you decide you do not agree with these Terms after starting the interview, you should stop immediately and inform the Interviewer that you are not proceeding. Any data recorded up to that point may still be processed unless you also request deletion as described above.
Upon termination of your use or completion of the interview, these Terms will continue to apply to any issues or liabilities that may arise from your use. Any licenses you granted to us (to use your content) will persist as needed to fulfill the purposes (for example, if your data is still retained for the Interviewer’s use or backups), but if you properly request deletion, that will end our usage of your content beyond legal requirements.
Limitation of Liability
To the fullest extent permitted by law, PolygrAI and its affiliates, officers, employees, agents, and partners shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from:
Your access to or use of (or inability to access/use) the Service, including any technical malfunctions, outages, or errors you may experience. (For example, if your camera fails to record properly or our server becomes unavailable mid-interview, we are not liable for any inconvenience or lost opportunity this might cause, though we will attempt to assist in rescheduling if possible.)
Any conduct or content of any party other than PolygrAI, including any offensive, illegal, or defamatory content that may be transmitted by an Interviewer or other users. (For instance, if the Interviewer’s questions are inappropriate or if they misuse your data, PolygrAI is not responsible for the Interviewer’s actions, though we want to know if our platform is misused.)
Any decisions made by the Interviewer or outcomes of the interview process. PolygrAI has no control over hiring or selection decisions, and we are not liable for any employment decision or other opportunity gain/loss that results from the use of our Service. This includes situations where you believe a decision was unfair or based on an inaccurate Analysis. You agree that your sole recourse for such disputes is with the Interviewer or through appropriate legal channels against that party, not against PolygrAI.
Any use of your data by the Interviewer beyond the scope of our Service. Once we have delivered your interview and analysis to the Interviewer, how they store, use, or further process that data is under their responsibility. While our agreements with them require lawful handling, we cannot be liable for breaches or misuse that occur on their side.
In any event, PolygrAI’s total cumulative liability arising out of or related to your use of the Service shall not exceed the amount of fifty Euros (€50) or equivalent in local currency. (Since you as an Interviewee typically pay no fee to use our Service, and the Service is provided for your convenience at the Interviewer’s behest, this nominal cap reflects that we have limited exposure to you.) Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of these limitations may not fully apply to you – in such cases, our liability is limited to the minimum extent permitted by law.
Disclaimer of Warranties: The Service is provided on an “AS IS” and “AS AVAILABLE” basis. PolygrAI disclaims all warranties and conditions of any kind, whether express, implied, or statutory, to the extent permitted by law. This includes, but is not limited to, any implied warranties of accuracy, reliability, fitness for a particular purpose, merchantability, title, and non-infringement. We do not warrant that the Service will meet your expectations or that it will always be secure or error-free or that any defects will be corrected. We also do not warrant that the analysis results will be correct or reliable. Use of the Service is at your own risk. You bear the responsibility of ensuring you have adequate computer security and that the environment is suitable for you to be recorded.
If you are dissatisfied with any aspect of the Service or these Terms, your sole and exclusive remedy is to discontinue your use of the Service.
Indemnification
You agree to indemnify, defend, and hold harmless PolygrAI and its officers, directors, employees, and agents, from and against any and all claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees and costs) that arise from or relate to: (a) your violation of these Terms or of any law or regulation; (b) your misuse of the Service or any content (including any attempt to misuse the platform, or any content you provided that caused harm to others or violated third-party rights); or (c) any dispute between you and an Interviewer or other third party in connection with the interview process (for example, claims that you were wrongfully denied a job, or claims you make against the Interviewer that result in a third-party claim involving our Service).
We reserve the right to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which event you will cooperate with us in asserting any available defenses. This clause means that if your actions cause us to be sued or incur costs, you will step in to protect us or reimburse us.
Third-Party Services and Links
The PolygrAI Interviewer platform itself typically runs in our web or app environment, but there may be instances where third-party services are involved. For example:
The interview might be conducted through an embedded video widget or a third-party video conferencing platform that PolygrAI integrates with at the Interviewer’s request. In such cases, you might be directed to use a service like Zoom, Microsoft Teams, or similar with PolygrAI’s analysis running in the background or alongside. If any third-party service is used as part of the interview, you may be subject to that third party’s terms and privacy policy as well. PolygrAI is not responsible for third-party services, so if, for instance, a video call is conducted via Zoom, any issues of connectivity or data handling on Zoom’s side are governed by Zoom’s terms. We will make efforts to notify you if you are leaving our platform or if another service’s terms apply during the process.
Our website or the interview invitation might contain links to external websites (for example, the Interviewer’s own careers page or a scheduling tool). We do not have control over those external sites, and we do not endorse or assume responsibility for any content, advertising, products, or other materials on or available from such sites. If you navigate to third-party sites, you do so at your own risk and should review their terms and policies.
To sum up: PolygrAI’s responsibility is limited to our own Service. We are not liable for any issues arising from your use of third-party platforms or services, even if accessed in conjunction with our Service.
Compliance with Laws
PolygrAI’s Service is used globally, but our operations comply with relevant laws and regulations of jurisdictions we operate in, particularly the EU (as noted, we adhere to GDPR for data protection). As an Interviewee, you also have a role in ensuring legal compliance:
By agreeing to these Terms, you confirm that you are not located in a country that is subject to an embargo or designated as a terrorist-supporting country by, for example, the EU or US law, and that you are not listed on any prohibited or restricted party list. (This is a standard legal assurance related to trade compliance; it’s unlikely to apply to standard job applicants, but we include it for completeness.)
You agree to follow all applicable laws in your region regarding the recording of communications. We have already asked for your consent to be recorded; likewise, if you are showing or involving anyone else in the video, ensure they are aware (generally you should be alone unless instructed otherwise). Do not violate any confidentiality or state secrets in your answers – if the interview asks about something that breaches a prior NDA you have, you should flag that to the Interviewer rather than disclose it on a recorded platform. PolygrAI is not responsible for any consequences of unlawful disclosures you make during an interview.
If you are in the EU or other regions with AI-specific regulations or guidance, note that PolygrAI is designed to be used in compliance with such laws (for example, the upcoming EU AI Act, etc.). PolygrAI provides transparency about the AI’s involvement (which we are doing here by explaining how it works). By using the Service, you confirm that you have been informed of and consent to the use of AI in evaluating your interview.
We may update certain features to comply with new laws (for example, if a law requires a specific icon or phrase to indicate AI is in use, we will implement that). Your cooperation and understanding in such compliance is appreciated.
Changes to These Terms
PolygrAI may update or modify these Terms of Use from time to time. If we make material changes (for example, expanding how we use data or adding significant new obligations for users), we will notify you by appropriate means – such as by sending an email to the address associated with your account (if you have one) or by presenting a notice when you access the Service. The date of last update at the top will always reflect when the latest changes were made.
Continued use of the Service after an update to the Terms constitutes your acceptance of the new Terms. If you do not agree to any revised Terms, you should refrain from using the Service and may contact us to request deletion of your data if relevant. For one-time interview participants who do not create accounts, typically the version of Terms you agreed to at the time of your interview will govern that specific interview interaction. However, if you return to use our Service again for a new interview, the then-current Terms would apply.

Governing Law and Dispute Resolution
These Terms and any dispute arising from your use of the Service or relating to your interview via PolygrAI are governed by the laws of the European Union and the laws of [Specify Country/Region] (without regard to its conflict of law principles). We specify EU law here particularly in respect to data protection and consumer rights; however, since PolygrAI’s operations may be headquartered in a specific country (e.g., if PolygrAI is based in an EU member state, that member state’s laws will apply), we will clarify the jurisdiction: [For example: “These Terms shall be governed by and construed in accordance with the laws of The Netherlands, and applicable EU regulations.”]
Any disputes that cannot be resolved amicably through our support team shall be subject to the exclusive jurisdiction of the competent courts of that specified jurisdiction, unless otherwise required by a mandatory law of your country of residence (if you act as a consumer, you may have the right to bring claims in your home jurisdiction).
If you are a resident in the EU, you may also have the right to use the EU Online Dispute Resolution (ODR) platform to facilitate resolution of disputes (this is an EU initiative for consumer disputes – we mention it here to comply with EU consumer law information requirements). However, please note that PolygrAI’s Service is typically provided to you for free (the Interviewer is our customer), so standard consumer dispute mechanisms may not neatly apply; regardless, we aim to resolve any concerns fairly.
Miscellaneous
Entire Agreement: These Terms (along with any referenced documents like our Privacy Policy) constitute the entire agreement between you and PolygrAI regarding your use of the Service as an Interviewee, superseding any prior agreements or communications relating to this subject matter. (For clarity: any arrangements between you and the Interviewer, such as confidentiality agreements or interview appointment letters, are separate from these Terms which strictly cover your relationship with PolygrAI.)
Severability: If any provision of these Terms is held to be invalid or unenforceable by a competent authority, that provision will be deemed modified to the minimum extent necessary to make it enforceable (or, if that’s not possible, severed), and the remaining provisions will remain in full effect.
No Waiver: If we do not enforce a provision of these Terms on any occasion, it does not mean we have waived our right to enforce it on future occasions. Any waiver must be explicit and in writing to be effective.
Assignment: You may not assign or transfer any of your rights or obligations under these Terms to anyone else without our prior written consent. PolygrAI may assign its rights and obligations to an affiliate or in connection with a merger or acquisition, or sale of assets, or by operation of law. These Terms will bind and inure to the benefit of the parties, their successors, and permitted assigns.
Language: These Terms are provided in the English language. If we provide translations in other languages (for convenience or legal requirement), the English version will prevail in case of any conflict or ambiguity in interpretation, to the extent permitted by law.
